What is a Category 3 Factory?

In accordance with the Thai Ministerial regulations issued pursuant to the 1992 Factory Act, a Category 3 Factory is a factory that employs over 50 workers, or 50 horsepower, or any other factory that contributes to pollution, regardless of whether it employs 50 workers, or is a 50 horsepower factory or not. In Thailand, a category 3 factory must be built away from public buildings, public areas, and must not turn into or cause any kind of a problem to the public. What Documents does a Category 3 Factory License Require?

Applying for a Category 3 factory license requires the following documents.

  • The company affidavit of the applicant’s company
  • Completely filled application form with the required information.
  • A comprehensive plan comprised of the details of the factory building, certified by either a professional engineer or the concerned authority from the Ministry of Industry.
  • A detailed plan of the factory machinery, certified through a professional engineer, or the concerned official from the Ministry of Industry.
  • Developing a factory, and later its activities may results in problems for the population around, increase pollution, cause damage to the environment, etc. Hence, it is necessary to submit a layout, plan, and a detailed report of the explanation of the measures of the potential damages, waste control, dangers, pollution, or any problems that may result in environmental damage, on account of the activities or operations conducted by the factory. This plan as well must be certified through a professional engineer or the concerned personnel from the Ministry of Industry.
  • A layout indicating the number of buildings to be constructed with the factory premises.
What is the Procedure to Setup a Factory outside Bangkok?
  • In some cases, the applicant/s might intend to construct a factory outside Bangkok. In such cases, he/ she must submit an application to the Provincial Industrial Office, or in some cases, to the Tambon Administration Organization.
  • On submission of the application, the concerned government authorities would visit the factory sight to inspect the premises, the structures, pollution control systems, etc.
  • Once the inspection is done, the government authority would prepare and submit a report to the concerned higher officials within 30 days of receiving the factory license application.
  • The higher official must give the decision, whether the application is approved or rejected, within 50 days of the receipt of the report.
  • In accordance with the ministry regulations, the said period of 30-50 days would also include the period wherein the applicant might make changes to the application, to the factory plan, or respond to any other concerns as raised by the other government authorities.
